LICENSING OF BOATS

  1. General Information

    Provision
    The law governing Licensing of Boats in Malaysia is the Merchant Shipping Ordinance 1952 under :

    1. Section 474 to 485, and

    2. Boat Rules, 1953 (No. 70 of 1952)

    Exemption from Licensing

    The following boats are exempted from this provision as follows :

    1. Any ship registered under Part IIA of M.S.O 1952

    2. in relation to West Malaysia, any native sailing ship licensed under this Part

    3. in relation to the State of Sabah, any vessel licensed under the M.S.O 1960 of Sabah, and

    4. in relation to the State of Sarawak, any vessel licensed under the M.S.O 1960 of Sarawak.

     

    When Boats To Be Licensed?

    1. Every boat plies at any port, river or place in Malaysia for any of the following purposes :

    a. Trade or business

    b. The transportation of any person other than for trade or business; or

    c. sports, leisure or recreational activity

    Qualification

    1. A person or a body corporate shall not be deemed to be an owner of a licensed boat unless it is wholly owned by persons of the following description :

    a. Malaysian citizen

    b. Permanent residence of Malaysia; or

    c. Corporation which are incorporated in Malaysia and wholly owned by Malaysian citizens.

    2. The Corporation shall produce documents relating to share-holding in the corporation as may be required by the Port Officer.

    Fees Schedule

    Reference is made to the Twelfth Schedule of M.S.O 1952. The fees charge for licensing boats is for a period of less than 12 months but not less than three, a proportionate fee may be charged but in no case shall such fee be less than 50 cents.

    The above forms can be purchased at any Port Office of the Marine Department Malaysia.

  2. License Application

    Boat are generally first licensed with submission of documents and followed by inspection. The following documents must be presented for licensing of the vessel:

    1. An application for the licensing of a boat shall be made on a prescribed form -

    o Application For Boat License, and

    o Application For Survey of Ship or Ship’s Equipment

    2. Documents to be submitted during application :

    o Builder Certificate - in case of a newly built boat

    o "Bill of Sale" - in case of change of ownership.

    3. Declaration of ownership

    4. Any boat to be licensed shall be subjected to initial inspection by the Port Officer to satisfy himself as to the construction, safety equipment and measurement of load lines of the boat.

    5. Date and time for the inspection will be decided by the Port Officer when the application is made.

    6. After the inspection and approval given, the Port Officer shall issue:

    o a "Permanent Boat Number" constituting of alphabet and numbers.

    7. Follow-up inspection for the boat marking base on the “Permanent Boat Number” issued will be performed after receiving owner application on this purpose.

    8. License will be issued by the Port Officer. The period of validity of the boat license shall not be longer than 12 month from the inspection date after the issuance date

    Licensing of Boats may take as quickly as seven (7) working days for issuance of license after the first survey has been made and satisfactory.

  3. Renewal of Boat License

    1. Application for renewal shall be made in a prescribed form - Application of renewal of License Boat.

    2. Applications shall be made within seven days before the date of expiry endorsed there on.

    3. Any boat wishing to have its license renewed shall be subject to inspection by the Port Officer. The period of validity of the boat license shall not be longer than 12 month from the inspection date.

    4. After the inspection and approval given a new license will be issued. Renewal Licensing of Boats may take as quickly as seven (7) working days for issuance of license after the survey has been made and satisfactory.


    CARVING AND MARKING REQUIREMENT

    1. Before licensing, the letter, numbers and name (if any) of each boat shall be appropriately marked and painted in white or in black, which shall not be less than 100 mm in height and of appropriate breadth. The letters shall precede the numbers.

    2. The marking should be permanently and conspicuously marked on both side of the bow and the stern as follows :

    XXX XXXXXXX

    No other markings are to be included in the marking area other than those above specified

    3. If the owner or Master neglects to cause the boat to be marked, or to keep her marked, or if any person conceals, removes, alters or defect in any manner whatsoever the letters or numbers or is a party or privy to so doing, he shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding RM 1,000.
